1. Who is responsible for your data
Arcasoft IT S.A. de C.V. (“Arcasoft IT”), with registered address at Calle Estado de Zacatecas 77, Gustavo A. Madero, C.P. 07550, Mexico City, is responsible for the processing of the personal data you provide through this website.
This notice is issued under Mexico's Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations and the Privacy Notice Guidelines.
For anything relating to your personal data, the only point of contact is contacto@arca-it.com.
2. What we collect and how
We only collect what you give us voluntarily, plus the technical data your browser generates when you visit the site.
Contact form
- Name
- Email address
- Phone number (optional)
- The borough or municipality where you are located (optional)
- The content of the message you write to us
Chat with our virtual assistant
The site offers a chat handled by an automated assistant, not a person. When you use it we collect:
- The full content of the conversation, which we keep in order to follow up
- Any name, email, phone number or company you choose to share during the conversation
Before the conversation starts we show you a notice with this information, and you must accept it to continue. Do not share passwords, card numbers, banking details or official identification through this channel: the assistant will never ask for them and they are not needed to help you.
Browsing data
- IP address, device type and browser
- Pages visited, time on site and the site you arrived from
3. What we do NOT collect
We do not request or process sensitive personal data (racial or ethnic origin, health status, genetic information, religious or philosophical beliefs, union membership, political opinions or sexual preference). We also do not collect financial or asset data through this site: purchases take place in our online stores, which have their own privacy notices and their own payment gateways.
4. What we use your data for
Necessary purposes, without which we cannot assist you:
- Responding to your requests, questions and quote enquiries
- Contacting you by email, phone or WhatsApp to follow up on what you asked for
- Preparing proposals and, where applicable, scheduling a site survey or visit
- Delivering and supporting the services you contract
- Meeting legal, tax and contractual obligations
Additional purposes, which are not necessary and which you may object to at any time without affecting the service you receive:
- Sending you information about our services, offers or news
- Measuring how the site is used in order to improve it
If you do not want your data used for these additional purposes, write to contacto@arca-it.com with the subject line “Limitación de uso”. Declining will never be grounds for denying you any service.
5. Who we share your data with
We do not sell or rent your personal data. To run the site we use technology providers that may process it on our behalf:
- Email and website hosting provider, to receive and store the messages you send us.
- Artificial intelligence provider, to generate the virtual assistant's replies. The text of your conversation is processed on servers that may be located outside Mexico, principally in the United States. That is why we ask you not to type confidential information there.
- Google Analytics, to measure site usage on an aggregate basis.
These transfers are those necessary to provide the service you requested and do not require additional consent under article 37 of the LFPDPPP. Beyond these cases, we do not transfer your data to third parties except at the request of a competent authority.
6. Cookies and tracking
This site uses Google Analytics 4, which places cookies in your browser to distinguish visitors and measure site usage in aggregate. We also store two of your own preferences in your browser: the language you chose and whether you have already accepted the chat terms. That information stays on your device and never reaches our servers.
You can block or delete cookies from your browser settings. If you do, the site still works, though you may have to choose your language again.
7. How long we keep your data
We keep your data for as long as a relationship with us exists and for the periods required by applicable law, principally tax and commercial law. Chat conversations and form messages are kept for as long as they are useful for following up with you. After that they are deleted or anonymised.
8. Your ARCO rights
At any time you may exercise the following rights over your personal data:
- Access: find out what data we hold about you and how we use it.
- Rectification: correct it if it is inaccurate or incomplete.
- Cancellation: ask us to delete it when it is no longer needed.
- Objection: object to our using it for a particular purpose.
You may also withdraw your consent to the processing of your data.
How to exercise them
Send your request to contacto@arca-it.com including:
- Your name and an email address where we can reply
- A copy of official identification proving who you are, or documentation proving representation if you are acting on someone else's behalf
- A clear description of the data concerned and which right you wish to exercise
- For rectification, the documents supporting the change
We will reply within a maximum of 20 business days. Where the request is granted, it will take effect within the following 15 business days. The process is free of charge; only shipping or reproduction costs could be charged, where applicable.
If you believe your right was not honoured, you may turn to Mexico's National Institute for Transparency, Access to Information and Personal Data Protection (INAI).
9. Chat terms of use
- The chat is handled by an automated assistant. It can be wrong or lack complete information.
- What the assistant tells you about products, availability, timelines or scope is indicative and is neither a quote nor a binding offer. Every formal quote is issued by a member of the team by email.
- The assistant does not give prices. Any prices you see come from our online stores and are subject to change without notice.
- Do not use the chat to send unlawful or offensive content, or third-party data without their consent.
- We may limit or suspend the chat service at any time, for maintenance or because of misuse.
10. Security
We apply reasonable administrative, technical and physical safeguards to protect your data against damage, loss, alteration, destruction or unauthorised use. The site runs over an encrypted connection (HTTPS). No system is infallible, so we ask you not to share through these channels any information that is not needed to assist you.
11. Changes to this notice
We may update this notice when our practices, our providers or applicable law change. The version in force will always be published on this page, with its last-updated date at the top. We suggest reviewing it from time to time.
